Under the Employment Permits Acts 2003, 2006 and 2024, it is a criminal offence to employ a non-EEA national without the appropriate employment permit or immigration permission. This is a strict liability offence, which means "I did not know" is not a defence. Employers should check original documents, such as a passport or an Irish Residence Permit, to ensure the correct stamp is there before employment begins.2. Issue written terms on time
The Terms of Employment (Information) Act 1994 requires employers to give every new employee a written statement of core terms within five days of starting, and a fuller written statement within one month. Miss the deadline, and an employee can be awarded compensation of up to four weeks' pay by the WRC.3. Set probation correctly
Since the introduction of the European Union (Transparent and Predictable Working Conditions) Regulations 2022, probationary periods in the private sector must not exceed six months, other than in limited, justified circumstances. The probation terms must be set out in writing at the start, not decided later. The takeaway: Slow onboarding and unsafe hiring are two sides of the same coin.
